These Terms and Conditions govern your access to and use of White Penguin ("the Platform"), operated by White Penguin Solutions ("we", "our", "us"). By signing up, accessing, or using the Platform, you agree to be bound by these Terms.

Description of Service​

Whit Penguin is a cloud-based preschool management platform that enables early childhood
education centres to manage: - Child records and attendance - Parent communication - Billing,
invoicing, and payments - Staff and classroom management - Learning documentation and reports

Eligibility

You must: - Be at least 18 years old - Be authorized to act on behalf of a registered school or childcare
centre - Provide accurate and complete registration information.

Account Registration and Security

- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities under your account.
- You must notify us immediately of any unauthorized access.

Subscription Plans and Payments

-White Penguin is offered on a subscription basis (monthly or annual)
-Fees are displayed on the Pricing page and may change with notice
-Payments may be processed via bank transfer, card, or USSD
-Subscriptions renew automatically unless cancelled

Failure to pay may result in suspension or termination of access.

Free Trials​

- Free trials are provided at our discretion
- Trial features or duration may be limited
- We reserve the right to withdraw trial access at any time

Data Ownership

You agree not to:
- Use the platform for unlawful purposes
- Upload harmful, abusive, or misleadingcontent
- Attempt to gain unauthorized access to systems
- Interfere with platform security or performance

Acceptable Use

- We process children's data only on behalf of schools
- Schools are responsible for obtaining parental consent

Availability and Support

- We aim for high availability but do not guarantee uninterrupted service
- Planned maintenance may cause temporary downtime
- Support is provided based on your subscription plan

Termination

We may suspend or terminate your account if: - You violate these Terms - Payments are overdue - Your
use poses a risk to the platform or other users
You may cancel your subscription at any time via your account or by contacting support.

Intellectual Property

We may suspend or terminate your account if:

Limitation of Liability

To the maximum extent permitted by law: - We are not liable for indirect, incidental, or consequential
damages - Our total liability will not exceed the fees paid in the last 12 months

updated Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria.
